GENERAL TERMS AND CONDITIONS

Last updated: 11 September 2026

  1. SCOPE AND CONTRACTING PARTY

1.1 These General Terms and Conditions (“Terms”) apply to all orders placed through the online store available at shop.sonoftheriver.de.

1.2 The contracting party and seller is:

Johannes Meyer
trading as Son of the River
Kirchweg 1b
37308 Heilbad Heiligenstadt
Germany

Email: info@sonoftheriver.com

1.3 A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An “entrepreneur” is a natural or legal person or partnership with legal capacity acting in the course of its trade, business or profession.

1.4 The version of these Terms available at the time the order is placed applies to the respective order. Any later amendment will not affect contracts already concluded.

  1. PRODUCTS AND PRODUCT INFORMATION

2.1 The essential characteristics of each product are described on the respective product page.

2.2 Product images are intended to represent the products as accurately as possible. Minor variations in colour may occur due to screen settings, lighting or photography. Such variations do not affect the customer’s statutory rights where the delivered product does not conform to the agreed description.

2.3 Information concerning sizes, materials, care instructions and product availability is provided on the respective product page. Customers are responsible for checking the selected product, colour and size before submitting an order.

  1. ORDERING PROCESS AND CONCLUSION OF CONTRACT

3.1 The presentation of products in the online store does not constitute a legally binding offer. It is an invitation to submit an order.

3.2 Customers may place products in the shopping cart and review or correct their order details before submitting the order.

3.3 By clicking the final button indicating that the order involves an obligation to pay, the customer submits a binding offer to purchase the products contained in the order.

3.4 After the order has been submitted, the customer will receive an automated order confirmation by email. Unless that email expressly states that it is only an acknowledgement of receipt, the order confirmation constitutes our acceptance of the order and the contract is concluded when the email is sent.

3.5 If a payment method results in immediate payment processing, the contract is concluded no later than when the payment transaction is confirmed.

3.6 The customer must provide a valid email address and ensure that emails sent by us or our service providers can be received.

  1. CONTRACT LANGUAGE AND STORAGE OF ORDER INFORMATION

4.1 The contract language is the language selected and displayed during checkout.

4.2 The customer will receive the order information and the legally required contractual information by email or another durable medium.

4.3 Customers can save or print these Terms before placing an order. Where a customer account is available, details of previous orders may also be accessible through that account.

  1. PRICES AND DELIVERY CHARGES

5.1 All prices displayed in the online store are total prices in euros. Where value-added tax is legally chargeable, it is included in the displayed price.

5.2 Delivery charges are not included in the product price unless expressly stated otherwise. Any applicable delivery charges will be displayed before the customer submits the order.

5.3 If delivery to a country outside the European Union is offered, customs duties, import taxes or other charges may be imposed by the destination country. Unless expressly collected during checkout, such charges are not included in the product price or delivery charges and must be paid by the recipient.

  1. PAYMENT

6.1 The payment methods available for an order are displayed during checkout.

6.2 Unless otherwise stated during checkout, payment is due when the contract is concluded.

6.3 Payment processing may be carried out by Shopify Payments or another payment service provider selected by the customer. Additional terms of the respective payment service provider may apply to the payment transaction. These terms do not limit the customer’s statutory rights against us as the seller.

6.4 If a payment cannot be completed for reasons attributable to the customer, we may request payment using another available payment method.

  1. DELIVERY

7.1 We deliver to the countries and regions available for selection during checkout. Any delivery restrictions will be displayed before the customer submits the order.

7.2 Delivery will be made to the delivery address provided by the customer. The customer is responsible for ensuring that the delivery information is complete and correct.

7.3 The applicable delivery period is displayed on the product page, during checkout or in the order confirmation.

7.4 Where advance payment has been agreed, the delivery period generally begins after payment has been received. This does not apply to pre-order products for which a separate delivery or dispatch period is stated.

7.5 Partial deliveries may be made where this is reasonable for the customer. The customer will not be charged additional delivery costs as a result of a partial delivery unless this has been expressly agreed in advance.

7.6 For consumers, the risk of accidental loss or damage passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods. This does not apply where the customer independently appoints a carrier that was not offered by us.

  1. PRE-ORDERS

8.1 Products offered before they are available for immediate delivery will be clearly identified as “Pre-order” or by a comparable notice on the product page.

8.2 The product page will state the expected dispatch date, delivery date or delivery period applicable to the pre-order.

8.3 Unless otherwise stated during checkout, the full purchase price for a pre-order is due when the contract is concluded. If a deposit, partial payment or deferred payment is offered, the applicable amount and payment date will be displayed before the order is submitted.

8.4 Production, transport or other circumstances may cause the expected dispatch or delivery period to change. If we become aware of a material delay, we will inform the customer without undue delay and provide an updated expected delivery period.

8.5 A delay notification does not limit the customer’s statutory rights. In particular, where the legal requirements are met, the customer may set a reasonable additional delivery period and withdraw from the contract if delivery is not made within that period.

8.6 Orders containing both immediately available products and pre-order products may be delivered together or separately, as indicated in the delivery information provided before checkout or in the order confirmation. A separate delivery initiated by us will not result in additional delivery charges.

8.7 Purchasing a pre-order product does not limit the statutory right of withdrawal. A standard product is not excluded from the right of withdrawal merely because it is manufactured or restocked after the order has been placed.

  1. RETENTION OF TITLE

The goods remain our property until the purchase price has been paid in full.

  1. STATUTORY RIGHT OF WITHDRAWAL

10.1 Consumers generally have a statutory right to withdraw from a distance contract.

10.2 Full information about the requirements, period, procedure and consequences of exercising this right is provided in our separate Right of Withdrawal Policy.

10.3 The Right of Withdrawal Policy also contains the model withdrawal form and information concerning the direct cost of returning goods.

10.4 The statutory right of withdrawal also applies to eligible pre-order products.

  1. VOLUNTARY RETURN POLICIES

Any voluntary return arrangement offered by us applies in addition to the customer’s statutory rights. A voluntary return policy does not restrict the statutory right of withdrawal or statutory rights relating to defective goods.

  1. STATUTORY RIGHTS FOR DEFECTIVE GOODS

12.1 The statutory rights concerning conformity and defects apply.

12.2 If a product is defective, damaged or does not correspond to the agreed description, the customer may be entitled to repair, replacement, a reduction in price, termination of the contract or damages in accordance with the applicable statutory provisions.

12.3 Customers should contact us at info@sonoftheriver.com and provide the order number and a description of the issue. This request does not impose any additional formal requirement or limit statutory rights.

12.4 Where the statutory requirements are met, we will bear the necessary costs of remedying a defect, including reasonable transport costs.

  1. LIABILITY

13.1 We are liable without limitation for damage caused intentionally or through gross negligence.

13.2 We are also liable without limitation:

a) for injury to life, body or health;
b) under the German Product Liability Act;
c) where we have fraudulently concealed a defect;
d) where we have expressly provided a guarantee; and
e) in all other cases where liability cannot legally be restricted or excluded.

13.3 In cases of ordinary negligence, we are liable only for the breach of an essential contractual obligation. An essential contractual obligation is an obligation whose performance is necessary for the proper fulfilment of the contract and on whose performance the customer may normally rely.

13.4 In such cases, liability is limited to the damage that was typical and reasonably foreseeable when the contract was concluded.

13.5 The above limitations of liability also apply for the benefit of our employees, representatives and agents.

13.6 The customer’s statutory rights relating to defective products remain unaffected.

  1. INTELLECTUAL PROPERTY

14.1 The content of the online store, including text, photographs, illustrations, graphics, designs, logos and product artwork, may be protected by copyright, trademark or other intellectual property rights.

14.2 Purchasing a product does not transfer any intellectual property rights relating to the product design, artwork or Son of the River brand.

14.3 Content from the online store may not be reproduced, modified, distributed or used commercially without prior permission from the respective rights holder, except where permitted by law.

  1. DATA PROTECTION

Information about the processing of personal data, the use of cookies and the customer’s data protection rights is provided in our separate Privacy Policy.

  1. GOVERNING LAW AND JURISDICTION

16.1 The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.

16.2 If the customer is a consumer habitually resident in another country, this choice of law does not deprive the customer of the protection provided by mandatory provisions of the law of the customer’s country of habitual residence.

16.3 The statutory rules concerning jurisdiction apply to consumers.

16.4 If the customer is a merchant, a legal entity under public law or a special fund under public law, the courts responsible for our registered place of business shall have jurisdiction to the extent permitted by law.

  1. ALTERNATIVE DISPUTE RESOLUTION

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
